The Supreme Court held that the apprehension of the appellant that he will not get a fair trial at the hands of Mr. Kainthla cannot be said to be unreasonable as the very judge had granted a huge cost of Rs. 5000 as lawyer's fee and Rs. 15000 as lawyer's fee in an interlocutory matter which was an extraordinary course. Accor5dingly, the appeal was allowed and the court directed that the case be transferred to the Court of District and Sessions Judge, Shimla.
