In this case, appellant obtained special leave from the court in the time allowed for vacating the premises of the respondent. The court has to decide whether time should be given to the appellant for giving vacant possession of the premises of the respondent. Dismissing the appeal, the court held that when the respondent has agreed to give time, the time should be allowed to the appellant and thus allowed four weeks time from date of order.
