High Court acquitted the respondent of the offence u s 302 IPC while retaining the convictions and sentences for the other offences. On an appeal by the state SC held that there was a material contradiction in the version of FIR and evidence given by the witness before the court. In the FIR, the allegation against the Respondent was of beating. Thus, court gave benefit of doubt and dismissed the appeal.
