The Supreme Court directed the Delhi Administration to absorb the petitioners in accordance with the prepared scheme for absorbing casual labourers that had been made effective from October 1, 1988. The scheme provided that any casual labourer who had worked for more than one year or more in the Horticulture Department should be regularised within six months with effect from October 1, 1988 if such casual labourer was fit to be regularized under the scheme as regular employee. It was held that each casual labourer working in the department shall get a salary at the rate equivalent to the minimum salary paid to a regular employee in comparable post.
