In a disciplinary proceeding against the constable for carelessness and negligence the punishing authority had taken into consideration a different charge of fabricated record which was not informed to the accused. Hence the High Court held that the punishing authority was not entitled to take into consideration matter beyond the charge for disciplinary proceedings in formulating the order of punishment. The Order of High Court does not call for any interference.
