Appellant was boy of fourteen years at time of commission of offence. Appellant contended that he could only be tried in a Children's Court. Question of being tried in Children Court was raised only before High Court and not before Court of Session. Supreme Court set aside appeal as it was not possible to raise such question at such later stage.
