Appellant caused loss of lakhs of rupees to State Government. State Government under Rule 139 reduced pension of appellant by 50% as it found appellant guilty. Supreme Court held that Rule 139 cannot be invoked as no departmental proceedings carried out under Rule 43. Criminal proceedings still found pending. Further held that pension cannot be reduced under Rule 139 unless appellant found guilty under Rule 43.
