High Court upheld constitutional validity of Section 217 (2), (3) and (4) of Act of 1988. Supreme Court upheld validity of Section 217 (2), (3) and (4) as three Judge Bench had earlier upheld constitutional validity of Section 170(b) of Act of 1957 which was almost similar to it.
