It was held that before passing an order u s 257 of Cr P C, there should exist a request explaining grounds for withdrawl of the complaint by the complainant and the Magistrate should be satisfied that there existed good grounds for the same. However, in the impugned order of the Magistrate it was not visible whether such a request was placed before the court and whether there was any good cause for passing an order u s 257 of Cr P C. The order of the Magistrate was set aside with a direction to proceed with the trial of the case.
