Respondent was informed by the appropriate authority vide letter dated 21-12-1995 that he was entitled to the rank of Assistant Sub-Inspector from 03-08-1992 but would not be entitled to any pay and allowances for the back period. High Court by its order allowed the back pay and allowances. However Supreme Court held that no back wages could be allowed for the period appellant had not actually assumed the charge.
