Secy. Deptt. Of post and Ors. V. Chander Pal Singh While hearing the matter concerning the conflict of opinion with regard to the Rule 9 (3) of the Post and Telegraphs Extra Departmental Agents (Conduct and Service) Rules, 1964 it was observed that the judgments were not conflicting as in one case question of constitutionality of Rule 9(3) was not assailed and as in another the said Rule was struck down as unconstitutional. The appeal was dismissed upholding the validity of the Rule 9 (3).
