The challenge in this appeal was non-compliance of an earlier order regarding regularization of services of employees. As per the earlier Order out of 42 persons working as part time tube well operators 26 persons were regularized as per Rules. It was observed by the Apex Court that for not regularizing the service contempt petition was not the proper remedy. Instead independent actions could be filed for not regularizing them.
