It was proposed by the appellant that lease could be renewed @ Rs.4,000 - pm and respondent agreed to it. But due to some reason lease deed could not be executed and the respondent was evicted. Prior to that corporation had filed a civil suit for recovering mesne profits @ Rs.8,000 - pm from September 1976 to April 1978 in addition to Rs. 16,000 - as arrears of rent from May 1976 to August 1976. SC modified the decree and judgment of the division bench and directed that mesne profits should be paid @ Rs. 4,000 - pm from May 1976 to April 1978 for use and occupation of suit premises with interest @ 6% pa from the date of suit till the date of payment.
