The Special Leave Petition has been placed for consideration before a three judge bench to decide on the question whether the petitioner Management is State within the meaning of Article 12 of the Constitution and whether it is amenable to writ jurisdiction of the High Court. A two-judge bench had ruled in favour of the petitioner but the respondent submits that since he was not a party to the proceedings, the judgment may not be res judicata, relying on the case of Unnikrisnan, J.P. v. State of A.P.
