It was observed that in the matter of Superintending Engineer, Public Health, U T Chandigarh V. Kuldeep Singh, the observations of Constitution Bench in the matter of Indra Sawhney V. UOI and in the matter of S. Vinod Kumar V. UOI, were not noticed by the bench of three judges deciding the matter. Thus, there was a doubt about the correctness of the decision in the case of Superintending Engineer, Public Health, U T Chandigarh V. Kuldeep Singh, thus, the case was recommended for hearing by Constitution Bench.
