The appellant had filed a civil suit for declaration claiming ownership rights over a plot, which was denied by the respondent. The question of ownership could have been decided by the appropriate authority only. But it was found by the civil court that notice of consolidation proceedings were not issued to the appellant. Thus, the Apex Court allowed the appeal directing District judge to decide the matter considering whether consolidation Authorities had complied with the provisions of the Act.
