The criminal appeal moved by the State against the judgment of High Court whereby setting aside the conviction and sentence under section 376 and 342 IPC dismissed on the grounds of medical and circumstantial evidence. The medical evidence disclosed that the Prosecutrix was habitual to sexual intercourse and also there was no injuries present on hands and hip and alongwith the circumstantial evidences lends credence to the version that she was the consenting party.
