ORDER

The Text below is only a summarized version of the order pronounced

The trial court and the lower appellate court had been accepted the plea of bonafide requirement. The High Court interfered and allowed the amendment to the pleadings and then directed a fresh decision on merits. The high Court only observed facts and circumstances of the case and did not decide the other questions, which were raised. The Supreme Court allowed the appeal and hold that the amendment should not have been allowed and the decision of the lower court dismissing the amendment application was correct.
