Husband of appellant filed suit for partition and possession of one third of joint family property. Defendant pleaded that it had acquired by adverse possession. High Court held that defendant had acquired adverse possession over joint family property. Plaintiff and defendant were co-sharers of property. Appeal allowed on ground that until property is not partitioned it continues to be Joint Hindu Family.
