In this appeal against the order of the High Court the matter to be decided was that whether the High Court was justified in setting aside the order of the lower court without framing any substantial question of law under Section 100 of the CPC. This court allowing the appeal held that the High court had not framed substantial question of law. This court remitted the case back to the High Court for disposing as per law.
