Dispute related to dilution of standards in making promotion by granting 10% marks for SC/ST candidates. Dilution is legally permissible when SC/ST candidates compete with general category candidates. Whether such dilution was legally permissible when examination was confined to only SC/ST candidates. Review petition filed as in another case such dilution was not approved and question was referred for reconsideration to a Constitutional Bench. Supreme Court held that even if subsequent Constitution Bench takes a contrary view it will be no ground for reviewing Judgment.
