When total no. of posts remain unaltered though as different pay scale as a result of regrouping due to which some of employees would go to a higher pay scale it would be a case of up gradation of post and not a case of additional vacancy being created to which reservation principal would apply. Supreme Court directed Union to rework seniority in light of above clarifications.
