Appellant made an endeavor to bring the case within ambit of Exception 4 of Section 300 of Indian Penal Code. Facts revealed that appellant has armed himself with a lethal weapon whereas deceased was unarmed. Apex Court held that when armed offender takes undue advantage of that weapon against an unarmed person he cannot get benefit of Exception 4.
