ORDER

1. Leave granted.

2. This appeal is directed against the judgment and order dated 20.09.2007 in Letters Patent Appeal No.511 of 2003 passed by the High Court of Judicature at Jabalpur (Madhya Pradesh).

3. We have heard learned counsel for the parties. We agree with the findings of the Division Bench of the High Court. However, in the facts and circumstances of this case, the respondent shall be treated as a regular employee of the appellant company - NTPC Limited from the date of his reinstatement i.e. from 08.09.2003. The arrears and the other benefits due to the respondent be given to him within four weeks from the date of communication of this order.

4. With these observations, the Civil Appeal is disposed of, leaving the parties to bear their own cost.
