1. Leave granted.

2. In view of the judgement            delivered in Jogendrasinhji Vijaysinghji v. State of Gujarat¹ we set aside the judgment of the Division Bench and restore the Letters Patent Appeal to its original number to be decided on its merits afresh.

3.  Parties shall appear before the High Court on 15th February, 2016.

4. In view of the above, the            appeals are allowed with no order            as to costs.
