Kurian Joseph,J.,

 

1. Heard the learned counsel appearing for the parties.

 

2. The issue raised in this appeal pertains to protection            of pay-scale and all consequential benefits in the case of the respondent, who was working as a Chargeman in the Railways.

 

3. We are informed that the respondent retired long back.       In that view of the matter, we do not want to disturb the benefits already drawn by the respondent.

 

4. Therefore, this appeal is dismissed leaving the question of law open.

 

 

4. In case the benefits arising out of the impugned judgment have not yet been settled / disbursed, the same shall be disbursed positively within a period of three months from today.
