Heard counsel for the parties. On appreciating the entire facts and circumstances of this case we modify the order of the High Court and pass the following order : (1) The appellant shall appear for interview before the Banking Services Recruitment Board, Madras on the Day and time as may be fixed by them. (2) In case the Board finds the appellant fit for appointment in banking service it will try to assign the appellant to the Indian Overseas Bank, Madras. If due to certain reasons that be not possible then he may be assigned to any other Bank which the Board thinks fit and proper to do. (3) In case the appellant is assigned to the Indian Overseas Bank, Madras, the said Bank will appoint him to the post he is found fit for appointment without giving effect to the impugned policy in his case. 3. There will be no order as to costs.
