The Himachal Pradesh Housing Board appointed appellant as manager and later realized that he was
not suitable to the post and down graded his post to that of Factory Manager at a lower scale of
Rs.400-Rs.1,100 - The appellant before the court agreed to accept the lower post but respondent
contended that being a chemical engineer, he was not suitable for it. In these circumstances court
directed the respondent to appoint appellant at the post of Factory Manager that too at the top point
in the scale of 400-1100.
