Compulsory retired in public interest on recommendations of High Court. Payment of three month salary inadvertently fell short by Rs. 354. High Court held that Order of compulsory retirement was bad as payment of three months salary in lieu of notice was a condition precedent to valid compulsory retirement which fell short by certain amount. On appeal Supreme Court held that only right of Government servant under such an Order was to get amount of three months pay and allowance in lieu of such notice.
