In view of the order passed by this Court in Civil Appeal No.4040 of 2011 (Arising
out of Special Leave Petition (C)No.362 of 2008) etc.etc. in State of Himachal
Pradesh Vs. Sarab Dayal on 5th May, 2011, the impugned judgment of the High
Court is set aside and the matters are remitted to the High Court for fresh
consideration. The appeals are disposed of, leaving the parties to bear their own
costs.
