No. 102 of 2007 (Altamas Kabir, Cyriac Joseph and Surinder Singh Nijjar JJ.) 16.08.2011 ORDER 1. This matter has appeared today for further directions pursuant to the order which had been passed on 4th July, 2011. 2. Today, we have been informed by Mr. Raval, learned ASG, that pursuant to the directions of this Court, all the schools, buildings and compounds in the Northeastern States have been vacated by the Armed Forces/Para-Military Forces of the Centre, except for one school in Kohima, Nagaland. Mr. Edward Belho, learned Advocate appearing for the State of Nagaland, submits that even the said building has been vacated. 3. Ms.Aparna Bhatt, learned Amicus Curiae, has submitted that she has not received full details of the submissions, which had been made both by Mr. Raval and Mr. Belho. However, Mr. Raval has also asked for some time to supply a copy of the affidavit filed by him on behalf of the UOI to Ms. Bhatt and other additional documents filed in due course. 4. As far as the rehabilitation of the children, who had earlier been trafficked and who it is submitted has been restored to their families and other children in the North-eastern States are concerned, learned ASG, Ms. Indira Jaising, appearing for the National Commission for Protection of Child Right (NCPCR) submits that information regarding the conditions of the schools of the education system in the North-eastern States were yet to be supplied. Only on receipt of such information could a proper scheme be prepared for implementing the provisions of the Right to Law Information Center 1 SpotLaw Education Act and to ensure that children in the north-eastern States receive education in terms of the said enactment. 5. We are informed that all the Northeastern States have filed affidavits in this regard and that letters have also been addressed to the Ministry of DONER in this connection. Ms. Jaising is requested to consider the various affidavits filed in respect of the North-eastern States, as well as by the UOI, and, thereafter, to suggest the framing of a scheme by which the provisions of the Right to Education Act could be implemented in these States, along with steps that could be taken to rehabilitate the children who had been restored back to their families. 6. Let this matter stand over till 19th September, 2011. The report to be filed on behalf of the NCPCR should be filed at least a week before the next date. 7. Learned advocates for the Northeastern States, as well as the Union of India, shall provide copies of their affidavits, which have also been filed or which are yet to be filed, to Ms. Jaising, learned ASG, appearing for the NCPCR, to give effect to this order.
